BY DOWNLOADING, INSTALLING, OR USING THIS APPLICATION, YOU ACKNOWLEDGE AND AGREE THAT:
- Soap making involves hazardous materials including sodium hydroxide (lye) and potassium hydroxide that can cause severe chemical burns, blindness, and other serious injuries.
- This Application does NOT teach you how to safely handle hazardous materials.
- This Application is a calculator and organizational tool only, NOT a safety guide.
- You are solely responsible for your safety and obtaining proper training from qualified sources.
- The Licensor is NOT responsible for any injuries, damages, or losses resulting from soap making activities.
1. Scope of License
This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("End User" or "you") and Burnished Labs, LLC, an Oregon limited liability company, doing business as Soaper App ("Licensor," "we," "us," or "our") for the use of the Soaper application ("Licensed Application" or "Application").
This Agreement is between you and the Licensor only, not with Apple Inc. ("Apple"). The Licensor, not Apple, is solely responsible for the Licensed Application and its content.
a) Grant of License
Subject to the terms of this Agreement, the Licensor grants you a limited, non-exclusive, non-transferable, revocable license to:
- Download, install, and use the Licensed Application on Apple-branded products that you own or control
- Use the Licensed Application in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions
b) Restrictions
You may NOT:
- Distribute, sell, lease, rent, lend, or sublicense the Licensed Application
- Reverse engineer, decompile, disassemble, or attempt to derive the source code
- Make derivative works based on the Licensed Application
- Remove, alter, or obscure any proprietary notices
- Use the Licensed Application for any unlawful purpose
- Use the Licensed Application to harm yourself or others
c) Family Sharing
This license may be used by you and other family members associated with your Apple ID through Family Sharing.
2. Consent to Use of Data
You agree that the Licensor may collect and use technical data and related information, including but not limited to:
- Technical information about your device, system, and application software
- Anonymous usage statistics to facilitate the provision of software updates, product support, and other services
This information is collected anonymously and does not personally identify you. For more details, please see our Privacy Policy.
Your recipes, inventory data, and personal content remain on your device and your iCloud account. The Licensor does not have access to this personal content.
3. Safety Disclaimer and Assumption of Risk
CRITICAL SAFETY INFORMATION:
a) Hazardous Activity
Soap making is an inherently dangerous activity involving caustic chemicals including sodium hydroxide (lye) and potassium hydroxide. These chemicals can cause:
- Severe chemical burns
- Permanent scarring and disfigurement
- Blindness and eye damage
- Respiratory injuries
- Death (in extreme cases)
b) Not a Safety Guide
THE LICENSED APPLICATION IS NOT A SAFETY TRAINING TOOL. It is a calculator and organizational tool designed to assist users who have already received proper safety training from qualified sources.
c) Educational Purpose Only
All information, calculations, suggestions, and content in the Licensed Application are for educational and informational purposes only. They do not constitute professional advice.
d) No Professional Relationship
Your use of the Licensed Application does not create any professional relationship between you and the Licensor.
e) Assumption of Risk
BY USING THE LICENSED APPLICATION, YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS associated with soap making activities, including but not limited to risks of injury, property damage, and death. You voluntarily assume these risks, known and unknown.
f) Release of Liability
You release, waive, and forever discharge the Licensor from any and all claims, demands, causes of action, damages, and liabilities arising from or related to your soap making activities, regardless of whether you used information from the Licensed Application.
g) User Responsibility
You are solely responsible for:
- Obtaining proper safety training
- Using appropriate personal protective equipment
- Working in properly ventilated areas
- Storing chemicals safely
- Following all applicable laws and regulations
- Verifying all calculations before use
- Ensuring the safety of yourself and others
4. No Warranty
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.
THE LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:
- The implied warranties of merchantability
- Fitness for a particular purpose
- Accuracy or completeness of calculations
- Non-infringement
- Satisfactory quality
THE LICENSOR DOES NOT WARRANT THAT:
- The functions contained in the Licensed Application will meet your requirements
- The operation of the Licensed Application will be uninterrupted or error-free
- Any calculations will be accurate
- Defects in the Licensed Application will be corrected
- The Licensed Application will be compatible with third-party software
NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY THE LICENSOR OR ITS AUTHORIZED REPRESENTATIVES SHALL CREATE A WARRANTY.
SHOULD THE LICENSED APPLICATION PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR:
- Personal injury
- Any incidental, special, indirect, consequential, or punitive damages whatsoever
- Damages for loss of profits
- Loss of data
- Business interruption
- Or any other commercial damages or losses
ARISING OUT OF OR RELATED TO:
- Your use or inability to use the Licensed Application
- Any calculations, information, or content in the Licensed Application
- Your soap making activities
- Chemical burns or other injuries
- Property damage
- Any defect in the Licensed Application
REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.
IN NO EVENT SHALL THE LICENSOR'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID THE LICENSOR FOR THE LICENSED APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50.00).
THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
6. Maintenance and Support
- Licensor Responsibility: The Licensor is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this Agreement.
- Apple's Role: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
- Support Contact: For support inquiries, please contact: support@soaperapp.com
- Updates: The Licensor may provide updates or upgrades to the Licensed Application at its discretion. You are responsible for installing updates.
7. Third-Party Terms and Services
a) Third-Party Components
The Licensed Application may contain or utilize third-party components subject to their own license terms. Your use of such components is governed by their respective terms.
b) Third-Party Services
The Licensed Application may enable access to third-party services such as:
- Apple's CloudKit for data synchronization (Premium feature)
- Google AdMob for advertising (free users only)
- Apple's StoreKit for subscription management
- Apple's Spotlight and Siri for system integration (optional)
c) Third-Party Terms
You agree to comply with all applicable third-party terms of service when using such services.
d) No Endorsement
The Licensor does not endorse and is not responsible for the content, accuracy, or practices of third-party services.
8. Intellectual Property
- Ownership: The Licensed Application, including all content, features, and functionality, is owned by the Licensor and is protected by copyright, trademark, patent, and other intellectual property laws.
- Claims of Infringement: If you believe the Licensed Application infringes your intellectual property rights, please contact: support@soaperapp.com
- Apple's Role: In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, the Licensor, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Your Content: You retain ownership of recipes and content you create within the Licensed Application.
9. Subscription Terms
The Licensed Application offers auto-renewable subscriptions and one-time purchases that unlock premium features. By purchasing a subscription, you agree to the following terms in addition to the rest of this Agreement and the Apple Media Services Terms and Conditions.
a) Subscription Plans
Current subscription options include:
- Soaper Premium Monthly: billed every month
- Soaper Premium Yearly: billed every year, includes a two-month free trial for new subscribers
Specific pricing for your region is displayed inside the Licensed Application at the time of purchase. Pricing may change with notice as permitted by Apple.
b) Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel at least twenty-four (24) hours before the end of the current period. Your Apple ID account will be charged for renewal within twenty-four (24) hours prior to the end of the current period at the then-current rate.
c) Free Trials
If you are eligible for a free trial, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription at the then-current rate unless you cancel before the trial ends. Eligibility for free trials is determined by Apple and the Licensor.
d) Cancellation
You may manage and cancel your subscriptions through your App Store Account Settings on your device. Cancellation takes effect at the end of the current billing period; you retain access to premium features until that time. Deleting the Licensed Application does NOT cancel your subscription.
e) Changes to Subscription Pricing
The Licensor may change subscription pricing at any time. If pricing changes for a subscription you already have, Apple will notify you of the change and require your consent before the new price takes effect.
f) No Refunds for Partial Periods
Except as required by applicable consumer-protection law (and except as Apple may grant in its sole discretion), subscription fees are non-refundable for partial billing periods. See Section 11 (Refund Policy) for additional detail.
g) Premium Feature Access
The specific features unlocked by a subscription may evolve over time. The Licensor reserves the right to add, modify, or remove premium features. Material reductions in premium feature scope will not occur during an active billing period that you have already paid for; if they do, you may be entitled to a pro-rated refund under applicable law.
10. Lifetime Purchase Terms
The Licensed Application may offer a one-time, non-consumable "Lifetime" purchase that unlocks the current premium feature set without a recurring subscription. By purchasing the Lifetime option, you agree to the following terms in addition to the rest of this Agreement.
a) One-Time Purchase
The Lifetime purchase is a single transaction. No recurring charges will be made. You will not be billed monthly or annually after purchase.
b) "Lifetime" Defined
"Lifetime" refers to the period during which the Licensor continues to publish and maintain the Licensed Application on the Apple App Store. It does NOT mean:
- The literal lifetime of the End User
- A perpetual commitment to maintain or update the Licensed Application
- A commitment to maintain any specific feature, integration, or third-party service
The Licensor will use commercially reasonable efforts to maintain the Licensed Application but does not warrant indefinite availability.
c) Restoration Across Devices
Your Lifetime purchase is tied to your Apple ID. You may restore your purchase on any Apple device signed in to the same Apple ID by using the "Restore Purchases" function in the Licensed Application.
d) Premium Feature Scope
The Lifetime purchase unlocks the same premium feature set as the Monthly and Yearly subscriptions. As noted in Section 9(g), the specific premium feature set may evolve. Lifetime holders receive ongoing access to the premium feature set as it exists from time to time.
e) Discontinuation
If the Licensor discontinues the Licensed Application or removes it from the Apple App Store, the Lifetime purchase ends with the discontinuation. The Licensor does not guarantee a specific minimum support period. In the event of discontinuation, the Licensor may, but is not obligated to, offer refunds, alternative products, or data export tools.
f) No Transferability
The Lifetime purchase is non-transferable except as permitted by Apple's Family Sharing.
11. Refund Policy
All purchases of subscriptions, in-app purchases, and the Licensed Application itself are processed by Apple. Refund requests are handled by Apple in accordance with Apple's refund policies.
a) Request Refunds Through Apple
To request a refund, visit https://reportaproblem.apple.com or contact Apple Support. The Licensor does not have the ability to issue refunds directly for App Store purchases.
b) Apple's Discretion
Apple grants or denies refunds at its sole discretion, except where consumer-protection law in your jurisdiction requires otherwise.
c) Statutory Refund Rights
If you reside in the European Union, the United Kingdom, Australia, or another jurisdiction with mandatory consumer-protection refund rights, those rights apply regardless of this Agreement.
d) Detailed Refund Policy
Additional refund policy information is available at https://soaperapp.com/refund and within the Licensed Application under Settings → Legal → Refund Policy.
12. Export Compliance
You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained.
You represent and warrant that:
- You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
- You are not listed on any U.S. Government list of prohibited or restricted parties
13. U.S. Government End Users
The Licensed Application and related documentation are "Commercial Items," as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable.
Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users: (a) only as Commercial Items, and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein.
14. Age Requirements and Minors
a) Minimum Age
The Licensed Application is intended for use by individuals who are at least thirteen (13) years of age. By downloading, installing, or using the Licensed Application, you represent that you are at least thirteen (13) years old.
b) Minors and Subscriptions
Individuals under the age of eighteen (18) (or the legal age of majority in their jurisdiction) may not purchase a subscription, the Lifetime option, or any other in-app purchase without the express consent and involvement of a parent or legal guardian. Parents and guardians are responsible for all purchases made through their Apple ID, including by minors using their device.
c) Children Under 13
The Licensor does not knowingly direct the Licensed Application to, or knowingly collect information from, children under the age of thirteen (13). If the Licensor learns that information has been collected from a child under thirteen (13), it will be deleted in accordance with applicable law (including the Children's Online Privacy Protection Act in the United States, "COPPA").
d) EU Minors (GDPR-K)
For users in the European Union, the minimum age for consent to data processing is sixteen (16), or such lower age as is set by the user's specific Member State (but not lower than thirteen (13)). Users below the applicable age require parental consent. The Licensor relies on Apple's Family Sharing controls for age-gating.
e) Safety for Minors
Soap making involves hazardous chemicals. Minors should NEVER engage in soap making activities without direct adult supervision. Section 3 (Safety Disclaimer) applies with particular force to minor users.
15. Privacy Rights
Your privacy is governed by the Privacy Policy, which is incorporated by reference into this Agreement.
a) Data Stored Locally
The vast majority of your data (recipes, inventory, batch records, photos, notes) is stored on your device and, if you enable iCloud, in your private Apple iCloud account. The Licensor does not have access to this content.
b) GDPR Rights (EU Users)
If you reside in the European Union, the United Kingdom, or another jurisdiction subject to the General Data Protection Regulation or analogous laws, you have rights including:
- The right to access personal data we hold about you
- The right to rectification of inaccurate data
- The right to erasure ("right to be forgotten")
- The right to restrict processing
- The right to data portability
- The right to object to processing
- The right to lodge a complaint with your local data protection authority

c) CCPA Rights (California Users)
If you reside in California, you have rights under the California Consumer Privacy Act ("CCPA"), including:
- The right to know what personal information we collect, use, disclose, and sell
- The right to delete personal information we have collected from you
- The right to opt out of the sale of personal information (the Licensor does not sell personal information)
- The right to non-discrimination for exercising your CCPA rights

d) Other Jurisdictions
Users in other jurisdictions with consumer-privacy laws (including Brazil's LGPD, Canada's PIPEDA, and similar) may have analogous rights. Contact us to exercise them.
e) Apple's Role
Apple's collection and use of your data is governed by Apple's privacy policy, not this Agreement.
16. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Licensor, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of this Agreement
- Your use or misuse of the Licensed Application
- Your soap making activities, including any injury, property damage, or death resulting from those activities (whether or not the Licensed Application contributed to them)
- Your violation of any law, regulation, or third-party right
- Any content you submit, post, or share through the Licensed Application
- Your unauthorized access to or use of any third-party data through the Licensed Application
The Licensor reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify the Licensor, and you agree to cooperate with the Licensor's defense of these claims.
This indemnification obligation will survive termination of this Agreement.
17. Dispute Resolution; Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
a) Informal Resolution First
Before filing a claim against the Licensor, you agree to attempt to resolve the dispute informally by contacting support@soaperapp.com and providing a written description of your claim. The Licensor will attempt to resolve the dispute informally within thirty (30) days of receiving your notice.
b) Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to this Agreement or the Licensed Application — whether in contract, tort, statute, fraud, misrepresentation, or any other legal theory — shall be resolved through final and binding arbitration, rather than in court, except as set forth below.
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, available at https://www.adr.org. The arbitration shall be conducted by a single arbitrator. The seat of arbitration is Multnomah County, Oregon, United States, and the language is English. The arbitrator's decision will be final and binding except as permitted by the Federal Arbitration Act.
c) Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND THE LICENSOR EACH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
d) Exceptions to Arbitration
Either party may bring a claim in small claims court if the claim qualifies under the small claims court's rules. Either party may also seek injunctive or other equitable relief in court for actual or threatened infringement of intellectual property rights.
e) 30-Day Right to Opt Out
You may opt out of this Section 17 by sending the Licensor written notice to support@soaperapp.com within thirty (30) days of first accepting this Agreement. The notice must include your name, the Apple ID associated with your Soaper purchases, and a clear statement that you wish to opt out of arbitration. Opting out will not affect the rest of this Agreement.
f) Applicable Law for This Section
This Section 17 is governed by the Federal Arbitration Act and applicable federal arbitration law. To the extent any portion of this Section 17 is found unenforceable, the unenforceable portion shall be severed and the remainder shall continue to apply.
g) EU, UK, Australian, and Other Consumer-Law Jurisdictions
If you reside in the European Union, the United Kingdom, Australia, or another jurisdiction whose consumer-protection law restricts mandatory pre-dispute arbitration or class action waivers between businesses and consumers, this Section 17 applies to you only to the extent permitted by applicable law. Where applicable consumer-protection law would render any portion of this Section 17 unenforceable, that portion does not apply to you, and you retain all rights granted by your local consumer-protection law.
18. Force Majeure
The Licensor will not be liable for any failure or delay in performance to the extent caused by events outside its reasonable control, including but not limited to: acts of God; natural disasters; war, terrorism, or civil unrest; epidemics or pandemics; labor disputes or strikes; failures of cloud infrastructure, internet service providers, or the Apple App Store; acts of government or regulatory bodies; cyberattacks; or any other event of force majeure.
If a force majeure event materially affects the availability of the Licensed Application for more than ninety (90) consecutive days, the Licensor will attempt to communicate the situation through reasonable channels (in-app notifications, the Soaper website, or App Store updates).
19. Termination
- Termination Rights: This Agreement is effective until terminated by you or the Licensor.
- Automatic Termination: Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms.
- Effect of Termination: Upon termination, you must: cease all use of the Licensed Application; delete all copies of the Licensed Application from your devices.
- Subscription Status on Termination: Termination of this Agreement does not automatically cancel an active subscription. You must cancel subscriptions separately through your App Store Account Settings.
- Data on Termination: Your data stored on your device and in your private iCloud account is not deleted by the Licensor upon termination. You retain control of that data and may export or delete it through standard iOS controls.
- Survival: The following sections shall survive termination: Section 3 (Safety Disclaimer), Section 4 (No Warranty), Section 5 (Limitation of Liability), Section 11 (Refund Policy), Section 16 (Indemnification), Section 17 (Dispute Resolution), and Section 20 (Miscellaneous, including Governing Law).
20. Miscellaneous
- Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Oregon, United States, excluding its conflicts of law principles. Subject to Section 17 (Dispute Resolution), any judicial action permitted under this Agreement shall be brought exclusively in the state or federal courts located in Multnomah County, Oregon.
- Severability: If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions shall remain in full force and effect.
- Entire Agreement: This Agreement, together with the Privacy Policy and the Refund Policy referenced herein, constitutes the entire agreement between you and the Licensor with respect to the Licensed Application and supersedes all prior agreements.
- Amendment: The Licensor reserves the right to modify this Agreement from time to time. For material changes, the Licensor will provide reasonable advance notice through in-app notifications, an updated Effective Date, or a notice on https://soaperapp.com/eula. Continued use of the Licensed Application after the Effective Date of a modification constitutes your acceptance of the modified Agreement. If you do not agree to a modification, you must discontinue use of the Licensed Application before the modification takes effect.
- Apple as Third-Party Beneficiary: You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this Agreement, and that upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
- Assignment: You may not assign or transfer this Agreement or your rights under it without the Licensor's prior written consent. The Licensor may assign this Agreement at its discretion, including to a successor in connection with a merger, acquisition, or sale of assets.
- Waiver: No failure or delay by the Licensor in exercising any right under this Agreement constitutes a waiver of that right.
- Headings: Section headings are for convenience only and do not affect interpretation.

BY DOWNLOADING, INSTALLING, OR USING THE LICENSED APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS, INCLUDING THE BINDING ARBITRATION AND CLASS ACTION WAIVER IN SECTION 17.
