1. Agreement to Terms

By downloading, installing, accessing, or using the Soaper application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Soaper App ("Company," "we," "us," or "our") governing your use of the App.

You represent and warrant that you are at least 18 years of age, or if you are under 18, that you have obtained parental or guardian consent to use this App and agree to these Terms.

YOUR USE OF THIS APP CONSTITUTES YOUR ACKNOWLEDGMENT THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS, INCLUDING ALL DISCLAIMERS AND LIMITATIONS OF LIABILITY CONTAINED HEREIN.

2. Educational and Informational Purpose Only

THE APP IS PROVIDED FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.

The App is designed as a calculator and organizational tool to assist hobbyist soap makers with recipe calculations, ingredient tracking, and workflow organization. The App is intended to supplement, not replace, proper education, training, and safety protocols for soap making.

The content, calculations, suggestions, and information provided by the App:

• Are for general informational and educational purposes only
• Do not constitute professional advice of any kind
• Are not intended to teach users how to make soap
• Do not replace the need for proper safety training
• May contain errors, inaccuracies, or omissions
• Should not be relied upon as the sole source of information
• Are provided "as is" without any guarantees of accuracy or completeness

The App is designed to be a helpful tool for those who have already obtained proper knowledge and training in soap making from qualified sources.

3. Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS ASSOCIATED WITH SOAP MAKING ACTIVITIES.

By using this App, you acknowledge and agree that:

• Soap making is an inherently dangerous activity involving caustic chemicals, heat, and other hazards that can cause serious injury, disfigurement, or death.
• Sodium hydroxide (lye) and potassium hydroxide are highly corrosive substances that can cause severe burns, permanent scarring, blindness, respiratory damage, and other serious injuries.
• You voluntarily assume all risks, known and unknown, associated with soap making activities, including but not limited to: chemical burns, thermal burns, respiratory injuries, allergic reactions, property damage, and any other injuries or damages.
• You are solely responsible for determining whether you have the necessary knowledge, skills, equipment, and safety measures to engage in soap making activities.
• The Company is not responsible for any injuries, damages, or losses that occur as a result of your soap making activities, regardless of whether you used information or calculations from this App.
• You release, waive, and forever discharge the Company from any and all claims, demands, causes of action, damages, and liabilities arising from or related to your use of the App or your soap making activities.

THIS ASSUMPTION OF RISK IS A MATERIAL TERM OF THESE TERMS AND IS ESSENTIAL TO THE COMPANY'S WILLINGNESS TO PROVIDE THE APP.

4. No Professional Advice

THE APP DOES NOT PROVIDE PROFESSIONAL, MEDICAL, SAFETY, CHEMICAL, OR LEGAL ADVICE.

• No Professional Relationship: Your use of the App does not create any professional relationship between you and the Company. The Company is not a safety consultant, chemical engineer, medical professional, or any other type of professional advisor.
• Not a Substitute for Professional Guidance: The App is not a substitute for professional safety training, chemical handling courses, or expert guidance. You should consult with qualified professionals before engaging in soap making activities.
• Medical Emergencies: In case of chemical exposure, burns, or other injuries, immediately contact emergency services and/or poison control. Do not rely on this App for medical or emergency guidance.
• Safety Equipment and Protocols: The App does not provide comprehensive safety training. You are responsible for researching, obtaining, and using appropriate personal protective equipment (PPE) and following proper safety protocols from qualified sources.
• Recipe Accuracy: While the App strives to provide accurate calculations, you are responsible for verifying all calculations and recipes before use. Chemical reactions can be unpredictable, and errors in calculations or execution can be dangerous.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF PROFITS, LOSS OF DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

THE COMPANY SHALL NOT BE LIABLE FOR ANY DAMAGES, INJURIES, OR LOSSES ARISING FROM:

• Your use of information, calculations, or suggestions from the App
• Your soap making activities, regardless of whether you used the App
• Errors, inaccuracies, or omissions in the App's content or calculations
• Chemical burns, thermal burns, or any other injuries
• Property damage or destruction
• Allergic reactions or skin sensitivities to soap products
• Any third party's use of soap products you create
• Your failure to follow proper safety protocols
• Your failure to use appropriate personal protective equipment
• Any other cause related to your use of the App

IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR PERSONAL INJURY OR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, AND REGARDLESS OF WHETHER THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CALCULATIONS, INFORMATION, OR CONTENT PROVIDED BY THE APP
• WARRANTIES THAT THE RESULTS OBTAINED FROM USE OF THE APP WILL BE ACCURATE OR RELIABLE
• WARRANTIES THAT ANY ERRORS IN THE APP WILL BE CORRECTED
• WARRANTIES THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

YOU ACKNOWLEDGE THAT:

• All calculations are estimates and may contain errors
• Recipe suggestions are not guaranteed to produce safe or successful results
• Quality metrics and predictions are approximations only
• The App may contain bugs, errors, or inaccuracies
• You are solely responsible for verifying all information before use

7. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, demands, causes of action, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App
• Your soap making activities, including any products you create
• Any injury, damage, or loss caused to yourself or any third party as a result of your soap making activities
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable law, regulation, or ordinance
• Any claim that products you created using information from the App caused injury, damage, or loss to any person or property

This indemnification obligation shall survive the termination of these Terms and your use of the App.

8. User Responsibilities

By using the App, you agree to:

• Safety Training: Obtain proper safety training from qualified sources before engaging in soap making activities. The App does not provide safety training.
• Personal Protective Equipment: Obtain and properly use appropriate personal protective equipment (PPE), including but not limited to: chemical-resistant gloves, safety goggles or face shield, long sleeves and pants, closed-toe shoes, and respiratory protection when needed.
• Ventilation: Work only in properly ventilated areas when handling chemicals.
• Chemical Storage: Properly store all chemicals according to manufacturer guidelines, away from children, pets, and incompatible substances.
• Verification: Independently verify all calculations, recipes, and information before use. Do not rely solely on the App.
• Emergency Preparedness: Know the location of safety equipment, have access to running water, and know how to contact emergency services and poison control.
• Compliance with Laws: Comply with all applicable laws, regulations, and ordinances related to chemical handling, soap making, and product safety.
• Third Party Safety: Take reasonable precautions to protect others from exposure to chemicals and unfinished soap products.
• Accurate Information: Provide accurate information when using the App.
• Lawful Use: Use the App only for lawful purposes and in accordance with these Terms.

9. Subscription and Payment Terms

• Premium Subscription: Certain features of the App require a paid subscription ("Soaper Premium"). Subscription options, pricing, and features are displayed within the App.
• Free Trial: New subscribers may be eligible for a free trial period. If you do not cancel before the trial ends, you will be automatically charged for the subscription.
• Billing: Subscriptions are billed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Billing Grace Period: If a payment fails at renewal, you will have a 16-day grace period during which Apple will attempt to collect payment. You will retain access to premium features during this period. If payment cannot be collected within the grace period, your subscription will be cancelled.
• Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial subscription periods.
• Refunds: Refund requests are handled by Apple in accordance with Apple's refund policies. The Company does not directly process refunds. To request a refund, visit https://reportaproblem.apple.com.
• Price Changes: The Company reserves the right to change subscription pricing. You will be notified of price changes in advance, and changes will take effect at the start of the next subscription period after the notice.
• Free Features: Certain App features are available without a subscription. The Company reserves the right to modify which features require a subscription.

10. Intellectual Property

• Ownership: The App and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, software, and the design, selection, and arrangement thereof) are owned by the Company and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
• Limited License: Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.
• Restrictions: You may not: copy, modify, or distribute the App; reverse engineer, decompile, or disassemble the App; remove any copyright or proprietary notices; use the App for commercial purposes without authorization; transfer your license to any third party.
• User Content: You retain ownership of recipes and content you create. By using the App, you grant the Company a non-exclusive license to store and process your content as necessary to provide the App's functionality.
• Feedback: Any feedback, suggestions, or ideas you provide about the App may be used by the Company without obligation or compensation to you.

11. Termination

• Termination by You: You may stop using the App at any time. To fully terminate, delete the App from your devices.
• Termination by Company: The Company may suspend or terminate your access to the App at any time, for any reason, without notice or liability.
• Effect of Termination: Upon termination, your license to use the App ends. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to: Assumption of Risk, Limitation of Liability, Indemnification, and Governing Law.

12. Governing Law and Dispute Resolution

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.
• Dispute Resolution: Any dispute arising out of or related to these Terms or the App shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
• Class Action Waiver: YOU AGREE TO RESOLVE DISPUTES WITH THE COMPANY ON AN INDIVIDUAL BASIS AND WAIVE YOUR RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.
• Venue: Any legal proceedings shall take place in the state or federal courts located in Hennepin County, Minnesota, and you consent to the personal jurisdiction of such courts.
• Time Limitation: Any claim arising out of or related to these Terms must be filed within one (1) year after the cause of action arose, or be permanently barred.

13. Changes to Terms

• Right to Modify: The Company reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting within the App.
• Notification: We will provide notice of material changes through the App or by other means. It is your responsibility to review the Terms periodically.
• Continued Use: Your continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

The invalidity of any provision in a particular jurisdiction shall not invalidate that provision in any other jurisdiction.
